Abstract


Congolese criminal justice encounters a lot of difficulties in the repression of sexual violence offenses. This concerns the slowness in the conduct of both pre-judicial and judicial instructions, and the failure to enforce criminal convictions. Factors favoring such non-fulfillment include delays in the delivery of judicial decisions outside the statutory time limit, the determination of the amount of compensation by the judge in accordance with his firm conviction, and the insolvency of convicted persons. To the facts stated above, we can add enforced execution against the condemned state, the procedural complexity required to execute a judgment, the very advanced state of disrepair and criminogeneity of the prisons, and houses of incarceration over the country also favor escapes. Evasion favors the non-execution of judicial convictions. To remedy this, restorative justice is proposed to the Congolese legislator. Indeed this form of justice offers several restorative paradigms of both the perpetrator of sexual violence, as well as society and victims. Based on this, criminal mediation, penal composition, the Family Group Conference, the Restorative Conference, the Sentencing Circle, and community service are more appropriate to criminal justice against sexual violence in Democratic Republic of Congo.

La justice pénale congolaise rencontre multiples difficultés lors de la répression des infractions de violences sexuelles. Il s’agit de la lenteur du déroulement des instructions tant préjuridictionnelle que juridictionnelle, le défaut d’exécution de condamnations pénales. Les facteurs favorisant ces inexécutions sont notamment la tardivité du prononcé des décisions judiciaires en dehors du délai légal, la détermination du montant d’indemnisation par le juge suivant son intime conviction, l’insolvabilité des condamnés .On peut y ajouter l’interdiction de voies d’exécution forcée contre l’Etat condamné civilement responsable, la complexité procédurale préalable à l’exécution d’un jugement, l’état de délabrement très avancé et la criminogénéité des prisons, des maisons d’arrêt du pays favorisent également les évasions. Or les évasions favorisent l’inexécution des condamnations judiciaires justement. Pour y remédier, la justice restaurative est proposée au législateur congolais. En effet cette forme de justice plusieurs paradigmes restaurateurs aussi bien de l’auteur des violences sexuelles, que de la société ainsi que des victimes. Dans cet ordre la médiation pénale, la composition pénale, la Conférence du groupe familial, la Conférence restaurative, le cercle de détermination de la sentence, les travaux d’intérêt général s’avèrent être plus adaptés à la justice pénale contre les violences sexuelles en République démocratique du Congo.
