Abstract


The Convention of the United Nations relative to the child's rights is the international legal Setting of reference for all question of the childhood. The Democratic Republic of Congo as having left taking since a lot of years, had to get in order taking its content in this legislation. This obligation has been executed with the advent of the law no 09/001 of January 10, 2009 carrying protection of the child. This legal setting had foreseen to put on foot of the judicial and administrative structures to attend this category of no one once it puts the act that the law qualifies default because its vulnerability imposes to reserve him a particular treatment. But practically, the applicability comes up against an unspeakable cacophony. On the one hand, in other cities and territories of the country, one simply notes the absence of these structures and on the other hand, it is a heterogeneous mixture between the jurisdictions of common right and jurisdiction for miners, procedure of common right and special procedure for miners. All these difficulties make that these miners don't benefit from an aid that the international and national texts reserve to them.

La Convention des Nations-Unies relative aux droits de l’enfant est le Cadre juridique international de référence pour toute question de l’enfance. La République Démocratique du Congo en étant partie prenante depuis beaucoup d’années, devait se mettre en ordre reprenant son contenu dans sa législation. Cette obligation a été exécutée avec l’avènement de la loi no 09/001 du 10 janvier 2009 portant protection de l’enfant. Ce cadre légal avait prévu de mettre sur pied des structures judiciaires et administratives pour assister cette catégorie de personne une fois qu’elle pose l’acte que la loi qualifie de manquement car sa vulnérabilité impose de lui réserver un traitement particulier. Mais dans la pratique, l’applicabilité se heurte à une cacophonie indicible. D’une part, dans d’autres villes et territoires du pays, on constate tout simplement l’absence de ces structures et d’autre part, c’est un mélange hétéroclite entre les juridictions de droit commun et juridiction pour mineurs, procédure de droit commun et procédure spéciale pour mineurs. Toutes ces difficultés font que ces mineurs ne bénéficient pas d’une assistance que les textes internationaux et nationaux leur réservent.
